The relation between Christianity and nation is a very old but also a permanent theme within the Ecumenical Movement. Our aim is to explain why this relation is so important for us, the Europeans, because Europe is in fact, a continent of nations that have to be known by their traditions and by the reciprocal manifestations which, unfortunately, are sometimes conflicting. This is why it is not very easy to speak or to write about it. From the Orthodox point of (...) view, the ideal of the nation can be completely integrated in the Christian ideal. Such an ideal makes possible the development of a nation’s natural qualities. It does not lead to a uniformity of nations, on the contrary, it leads to their growth within the unity of the Christian faith. (shrink)

In the context of the Union of Greater Romania, a problem specific to the development of the Romanian society and of the re-united national state was the regulation of the status or the varied religious cults. It is well known that under the Older Romanian Kingdom, the Orthodoxy was a state religion. The other cults – Lutheran, Catholic, Mosaic, and Moslem – represented small numbers of believers and had not been regulated under the law; they were tolerated. Following the Union (...) of 1918, the Romanian State came to accommodate not just one, but several denominations. Consequently, it had to clarify its relations with the cults in the Romanian provinces of Bucovina, Basarabia, Banat, and Transylvania. These cults which had not existed in the Older Kingdom functioned according to the legislative systems they had belonged to before 1918. Thus came the necessity of establishing the unitary status for the minority cults, which, given the diversity of their religious doctrines, rituals and interests, posed new problems to be settled for the government policy. This also should be the focus of the debates surrounding the forthcoming law of the cults in Romania. (shrink)

Up to the present, there have not been any specific norms regarding medically assisted human reproduction in Romanian legislation. Due to this situation the general legislation regarding medical assistance, the Penal and Civil law and the provisions of the Code of Deontology of the Romanian College of Physicians are applied to the field of medically assisted human reproduction. By analysing the ethical and legal conflicts regarding medically assisted human reproduction in Romania, some characteristics cannot be set apart because they derive (...) from religious, cultural and socio-economic aspects. In this article the authors identify the development stages of medically assisted human reproduction in Romania, beginning from these characteristics and insisting upon the failure of the legal system in this specific field. The authors consider that the law regarding medically assisted human reproduction cannot be effective because it did not take into account the ethical and cultural aspects that might appear. Furthermore, in this framework of the legal process, no public debate involving the representatives of civil society was undertaken although the Council of Europe Oviedo Convention approved by our country according to law no. 17/2001 stipulated exactly this working method. This paper attempts to upgrade Deleuze and Guattari’s concept of nomadism to the contemporary work- and war-driven displacement of peoples in/to Europe. Starting from Augustin Ioan and his 2005 book Poverism, where he brought up the concept of living along trajectories (of migration), the two authors of the paper question the all-powerful status of place as envisioned by Heidegger at the conjunction between dwelling and being at home in one place. Along such trajectories that unite a point of departure (...) and a tentative of arrival destination, contemporary migrants never leave their first home for good, nor do they ever arrive completely in a certain location. Even the alternative to displacement, the concept of homey feeling, was never studied outside the policies of major chain hotels, where it is provided a simulacra of arriving situations for frequent travelers. The paper questions the scientific rather than ideological problem of an eventual biological successor of the mankind. The concept of superhumans is usually linked to Nietzsche or to Heidegger’s criticism or even to the ideology of Nazism. However, the superhuman can be also viewed as that biological species who will originate from humans eventually in the course of evolution.While the society is reached a natural limitation of globalism, technics depends on the amount of utilized energy, and the mind is restricted (...) by its carrier, i.e. by the brain, it is language which seems to be the frontier of any future development of humans or superhumans. Language is a symbolization of the world and thus doubling in an ideal or virtual world fruitful for creativity and the modeling of the former. Consequently, the gap between the material and the ideal world is both produced by and productive for language. (shrink)

Against much of the philosophical tradition, Spinoza and Nietzsche defend an understanding of freedom opposed to free will and formulated as an ethical ideal consisting in a transition from a smaller to a greater power of acting. Starting from a shared commitment to necessity and radical immanence, they present freedom as a passage to a greater power of self-determination and self-expression of the body. Nevertheless, the continuities between their power ontologies and their respective commitments to a life of knowledge break (...) down in their discussion of the various possible manifestations of power. I will argue that Nietzsche's distinctive formulation of power as struggle between wills to power enables him to formulate the question of the qualitative dimension of empowerment in a way that is foreign to Spinoza's rational determinism. While acknowledging the profound similarities, I will argue that we must see Nietzsche's discussion of affirmation as the culmination of his disagreement with his predecessor on the topic of freedom and empowerment. This article aims to address the metaphysical dimension of cosmological models, be they mythological, philosophical, religious or modern scientific, using multidisciplinary and transdisciplinary methodology. Such an approach is a novelty, both in the theological field and in the philosophical field and secular sciences, which studies the origin of man and the universe. Contribution: The originality of this article consists in introducing the concept of transcendental cosmology, which, along with spiritual cosmology can be a serious theological and philosophical reply to the (...) According to the social contract theory, in order to achieve justice, people grouped themselves in societies. Historically speaking, judges appeared long before the legislator which means that justice was the first element of the social life. Therefore, it expresses the social ethics of a particular time and requires a minimum of credibility. Excessive pragmatism and utilitarianism have kidnapped more and more of what is humane, superior and sacred in the act of justice, and “secularized” it. As Eliade said in The (...) Sacred and the Profane, the sacred is something which is totally different, a space of radical otherness which overshadows the physical territory. This shading manifests itself through limitation, sequencing, reiteration and keeping what is sacred there, even in a courtroom, through ritualization. (shrink)

C ontemporary religious terrorism propels in the forefront of philosophical, sociological, anthropological and political discussions and analysis the issue of religious violence. The violence belongs to the nature itself of religion? If so, what mechanisms can be activated to reduce violence? How to reconcile Christianity's central idea - the love of our neighbor - with the sacred violence thesis? How can the idea of religious violence be reconciled with the idea of religious love? Weak thinking, that is the logic of (...) a weak thinking may be a solution? We try to answer to such questions by appealing to the debate of ideas offered by the French anthropologist René Girard and the Italian philosopher Gianni Vattimo. (shrink)

Existential-Phenomenological Support Groups Addressed to Parents of Childrens with Various Neurodevelopmental Disorders: Principles, Models, Implementation and Functioning Features. This article aims to present the principles, techniques and models of existential-phenomenological philosophical counseling, as well as the way in which philosophical practice can be used to support discussions within support groups addressed to parents of children with disabilities. A model of philosophical existential-phenomenological group counseling will also be proposed, addressing the parents of children diagnosed with autistic spectrum disorder. The phases of (...) the group counseling process as well as individual counseling through phenomenology will be reproduced in this article, which will also propose possible themes that discussions in workshops with parents of children with disabilities can be based on. In order to study the intelligent collection system of moving object trajectory data under cloud computing, information useful to passengers and taxi drivers is collected from massive trajectory data. This paper uses cloud computing technology, through clustering algorithm and density-based DBSCAN algorithm combined with Map Reduce programming model and design trajectory clustering algorithm. The results show that based on the 8-day data of 15,000 taxis in Shenzhen, the characteristic time period is determined. The passenger hot spot area is obtained by (...) clustering the passenger load points in each time period, which verifies the feasibility of the passenger load point recommendation application based on trajectory clustering. Therefore, in the absence of holidays, the number of passenger hotspots tends to be stable. It is reliable to perform cluster analysis. The recommended application has been demonstrated through experiments, and the implementation results show the rationality of the recommended application design and the feasibility of practice. In this article, I set out a theoretical framework for analyzing fictional copyright protection of fictional characters in literature. Using this framework, I argue that the two most prominent approaches that U.S. courts have adopted with respect to fictional character copyright (the Nichols test and the Sam Spade “Story Being Told” test) are unsustainable. The idea of distinct delineation that came out of Nichols may be understood in two ways: on one view, fictional characters are distinctly delineated if they deviate (...) from a literary type. On the other view, they are distinctly delineated if they are attributed a sufficient number of properties in the fictions where they appear. Both views succumb to serious objections, while the test in Sam Spade is no better. The failure of the two judicial tests suggests that, instead of asking questions about fictional character copyrightability, courts should instead focus on the substantial similarity question. In the last part of the paper, I draw a distinction between two types of fictional character copyright infringement cases (transformations and transfers), and suggest that a Nichols-type substantial similarity analysis is all that is required in transformation situations. Although the focus of this article is U.S. law, the issues discussed and the analyses proposed may prove helpful in addressing fictional copyright in other jurisdictions as well. (shrink)

Formalised knowledge systems, including universities and research institutes, are important for contemporary societies. They are, however, also arguably failing humanity when their impact is measured against the level of progress being made in stimulating the societal changes needed to address challenges like climate change. In this research we used a novel futures-oriented and participatory approach that asked what future envisioned knowledge systems might need to look like and how we might get there. Findings suggest that envisioned future systems will need (...) to be much more collaborative, open, diverse, egalitarian, and able to work with values and systemic issues. They will also need to go beyond producing knowledge about our world to generating wisdom about how to act within it. To get to envisioned systems we will need to rapidly scale methodological innovations, connect innovators, and creatively accelerate learning about working with intractable challenges. We will also need to create new funding schemes, a global knowledge commons, and challenge deeply held assumptions. To genuinely be a creative force in supporting longevity of human and non-human life on our planet, the shift in knowledge systems will probably need to be at the scale of the enlightenment and speed of the scientific and technological revolution accompanying the second World War. This will require bold and strategic action from governments, scientists, civic society and sustained transformational intent. (shrink)

The authors examine the Slovak ethos of plebeian resistance to the First World War in several of its forms. First, they examine intellectual forms of resistance against war, against its Christian justification. Several Slovak authors emphasized that the First World War was in direct contradiction to Christian ethics, asserting that it served as proof of the failure of all European nations and their elites, who were proud of their humanity and ability to solve problems peacefully. Secular authors who based their (...) opposition to the First World War on universal cultural and moral values represented the second form of resistance. After the end of the war, they also expected the equal rights of the Slovak ethnic group in the new post-war situation. The third form of resistance is literature, and the authors of the article focused mainly on Milo Urban’s novel Živý bič (1927) as the most important anti-war novel of Slovak interwar literature reflecting wartime events in the Orava village of Ráztoky. The present study intends to demonstrate that there is no logical-formal inconsistency in the Christian Trinity. However, the demonstration requires specific tools, other than those of classical logic. There are many older or newer attempts that try to remove the thesis of the inconsistency of the Christian Trinity. There is often a call for mathematical tools. As far as we are concerned, we will appeal to co -inherence and the nesting relationships specific to the Christian Trinity, as they appear especially (...) in Augustine’s work. We advance the hypothesis that Augustine's metaphor "heaven of heavens" has a foundational role in the logical plane of explanation. In this sense, Augustine points out that in the "heaven of heavens", reason does not know "in part", but it knows everything suddenly, entirely, as in a totality. This totality with a founding role functions as a principle, which we can call the principle of free totality. But the co -belonging of entities in the free and founding totality also expresses co -inherence. Divine persons are an emanation of God. That is why we are talking about co -inherence. The "co" particle points out that the starting point is in the free totality of God, and that this totality logically precedes the rest of the process. Thus, we can consider the term "the Christian Trinity" as a nested term, as co -habitation. The totality of God is not a generalization in the spirit of the Aristotelian abstraction, but rather a particularity, a "personalization" that does not cancel the individual, but it highlights in instantiation. In this sense, the Christian God is not an abstraction, but a divine Being in three persons, in whom He instantiates. The logic of this process is the one of vagueness. (shrink)

The present study starts from the question if there can be any logic of religion. The answer is affirmative for logic in a wide sense. The attempts from the logic of beliefs account for this. However, the study focuses on the specific of the logic of religious terms, a less approached domain by logicians and philosophers. In this line issues like those of the logic of analogy, of the distinctions between the specific, general and total content of terms, between logical (...) distributive and collective conjunctions, etc are brought into discussion. In the end, dogmatic concepts are analyzed, as the core of religious concepts. (shrink)

This article explores the development of the theme of the Life-giving Spring in Byzantine iconography. The path towards its establishment was initiated at the moment when a representation rule, an original convention was set. Thereafter, because of its diffusion in time and space, the theme became enriched by particular mentalities and sensibilities of the epochs and the communities that adopted it as a form of devotion for the Virgin Theotokos. As a result, the representations we have known so far are (...) extremely varied. CONTRIBUTION: The final purpose of this approach, as well as its contribution, is to highlight the diverse unity of the iconographic tradition and illustrate both the evolution of the theme in the painting of Romanian church artists and its gradual refinement through the incorporation of diverse nuances and new perspectives. The term “rationality” is applied to many different things, from beliefs and preferences to decisions and choices, actions and behaviors, people, collectivities, andinstitutions. Therefore this paper will limit its considerations only to social preferences and choices in order to clarify the role of rationality in social explanation. The paper will focus on degrees of rationality, calling upon the concept of transitivity for help.

Melchizedek’s meeting with Abraham in the King’s Valley would mark the history of the chosen people. As king of Salem and priest of the Almighty God, Melchizedek meets the patriarch with bread and wine and then blesses him in the name of the God they both served. Assuming this liturgical ritual Abraham offers Melchizedek a tenth of everything, by this acknowledging and accepting his sacerdotal service. Even though at a first sight their gestures are somewhat natural, we will understand going (...) through our study that the attitude of each character implies a deeper significance. This is emphasized firstly in psalms, in the context of several Messianic sentences, which refer to an eternal priesthood that finds its origins not in the service of Aaron, but in that of Melchizedek. This text would generate and fundament later the Pauline discourse on the priesthood of Jesus Christ and implicitly of the Christians. The resemblance of Melchizedek with Jesus Christ is maximized by Saint Apostle Paul who states that the king of Salem was “without father or mother, without genealogy, without beginning of days or end of life”. Who is, in fact, this mysterious character? Why did the Hebrew want to identify him with a known biblical character? What are the reasons that determined the Christian authors to recompose the history of this character? These are just a few of the questions we intend to answer through the research that we are about to present. (shrink)

The adoption of the Legal Codes has generated a debate regarding use therein of the concept of family. Today, the family is in an area of decline due to profound socio-economic mutations, which have caused several processes to become acute, such as individualization, divorce, abandonment of the prospect of marriage, increase in number of abortions, deterioration of the condition of children and adolescents. In spite of all this, the Legal Codes have preserved the traditional concepts. Likewise, the development of NRTs, (...) insemination, surrogate mothers, demands for rights for the gay couples and their fight for acknowledgement have also contributed to this socio-cultural shift. We use the concept of family in its classical meaning; any other meaning configurations remain in the area signifying a couple/pair that do not have the possibility of procreation in themselves. Under the circumstances, we plead for the reconstruction of the family. (shrink)

This paper proposes a model of the Artificial Autonomous Moral Agent (AAMA), discusses a standard of moral cognition for AAMA, and compares it with other models of artificial normative agency. It is argued here that artificial morality is possible within the framework of a “moral dispositional functionalism.” This AAMA is able to “read” the behavior of human actors, available as collected data, and to categorize their moral behavior based on moral patterns herein. The present model is based on several analogies (...) among artificial cognition, human cognition, and moral action. It is premised on the idea that moral agents should not be based on rule-following procedures, but on learning patterns from data. This idea is rarely implemented in AAMA models, albeit it has been suggested in the machine ethics literature (W. Wallach, C. Allen, J. Gips and especially M. Guarini). As an agent-based model, this AAMA constitutes an alternative to the mainstream action-centric models proposed by K. Abney, M. Anderson and S. Anderson, R. Arkin, T. Powers, W. Wallach, i.a. Moral learning and moral development of dispositional traits play here the fundamental role in cognition. By using a combination of neural networks and evolutionary computation, called “soft computing” (H. Adeli, N. Siddique, S. Mitra, L. Zadeh), the present model reaches a certain level of autonomy and complexity, which illustrates well “moral particularism” and a form of virtue ethics for machines, grounded in active learning. An example based on the “lifeboat metaphor” (G. Hardin) and the extension of this model to the NEAT architecture (K. Stanley, R. Miikkulainen, i.a.) are briefly assessed. (shrink)

The previous two parts of the paper demonstrate that the interpretation of Fermat’s last theorem (FLT) in Hilbert arithmetic meant both in a narrow sense and in a wide sense can suggest a proof by induction in Part I and by means of the Kochen - Specker theorem in Part II. The same interpretation can serve also for a proof FLT based on Gleason’s theorem and partly similar to that in Part II. The concept of (probabilistic) measure of a subspace (...) of Hilbert space and especially its uniqueness can be unambiguously linked to that of partial algebra or incommensurability, or interpreted as a relation of the two dual branches of Hilbert arithmetic in a wide sense. The investigation of the last relation allows for FLT and Gleason’s theorem to be equated in a sense, as two dual counterparts, and the former to be inferred from the latter, as well as vice versa under an additional condition relevant to the Gödel incompleteness of arithmetic to set theory. The qubit Hilbert space itself in turn can be interpreted by the unity of FLT and Gleason’s theorem. The proof of such a fundamental result in number theory as FLT by means of Hilbert arithmetic in a wide sense can be generalized to an idea about “quantum number theory”. It is able to research mathematically the origin of Peano arithmetic from Hilbert arithmetic by mediation of the “nonstandard bijection” and its two dual branches inherently linking it to information theory. Then, infinitesimal analysis and its revolutionary application to physics can be also re-realized in that wider context, for example, as an exploration of the way for physical quantity of time (respectively, for time derivative in any temporal process considered in physics) to appear at all. Finally, the result admits a philosophical reflection of how any hierarchy arises or changes itself only thanks to its dual and idempotent counterpart. (shrink)

Hilbert arithmetic in a wide sense, including Hilbert arithmetic in a narrow sense consisting by two dual and anti-isometric Peano arithmetics, on the one hand, and the qubit Hilbert space (originating for the standard separable complex Hilbert space of quantum mechanics), on the other hand, allows for an arithmetic version of Gentzen’s cut elimination and quantum measurement to be described uniformy as two processes occurring accordingly in those two branches. A philosophical reflection also justifying that unity by quantum neo-Pythagoreanism links (...) it to the opposition of propositional logic, to which Gentzen’s cut rule refers immediately, on the one hand, and the linguistic and mathematical theory of metaphor therefore sharing the same structure borrowed from Hilbert arithmetic in a wide sense. An example by hermeneutical circle modeled as a dual pair of a syllogism (accomplishable also by a Turing machine) and a relevant metaphor (being a formal and logical mistake and thus fundamentally inaccessible to any Turing machine) visualizes human understanding corresponding also to Gentzen’s cut elimination and the Gödel dichotomy about the relation of arithmetic to set theory: either incompleteness or contradiction. The metaphor as the complementing “half” of any understanding of hermeneutical circle is what allows for that Gödel-like incompleteness to be overcome in human thought. (shrink)
